Acceptable Use Policy for Blackbaud Email - Action Alerts

We received the Blackbaud popup message last week regarding use policy for email. One area I'm unclear on is what else might be included in "Implied" consent. Specifically in relation to Action Alerts. We recently began not including an opt-in checkbox on our action alerts. This is something we've seen other orgs doing and there is language letting folks who take action know they are being opted in. What's funky about this way of getting opt-ins is that the unsubscribe function drops out of the wrapper for all autoresponder emails making it impossible to opt-out at that point. 


Wondering what others are doing in this case, what's the best practice and if this new use policy applies to other tools in Luminate besides email.

    As long as you are clear that the action the user is taking will result in their opt in to receive communications, you are following the policy.  Autoresponders are messages triggered directly by user action so they aren't impacted by opt out (which is why the unsubscribe link is stripped out).  You aren't required to do this, but a good practice would be to include a link to the email preferences page in your stationery so that users could opt out (or in!) to global email or interests for your site.  The policy here is specifically for email but there is an broader acceptable use policy here
