Need a Way to Properly Handle Implied Consent

I work for a Canadian nonprofit and thus we're subject to CASL.



What we need is an ability to manage and market to an implied-consent constituent list.  Under CASL, a constituent falls under “implied consent” if they haven’t provided express consent to be emailed but have had some sort of interaction with your organization (e.g. donated, attended a workshop, etc.) within two years of the communication piece.  As such, Luminate would have to be able to:


 
  • Easily query for constituents that have either donated or registered for an event within two years of email marketing piece

  • Email all constituents that are part of this query, regardless of whether or not they’ve provided express consent

  • Automatically suppress all constituents that have expressly unsubscribed from all email communication.



I've spoken extensively to BB support and to our reps about this topic and they suggest I post the request on this community board to guage the urgency / need for a solution. As a marketer, I think communicating with this group of constituents is crucial for the success of our organization and I hope others feel the same.
