Obtaining consent for recurring credit card transactions

Options
Hi,

Recently, VISA (at least in Canada) has mandated that we need to capture some form of "consent" for keeping the info needed for recurring credit card charges. Does anyone have a good solution for implementing this kind of consent on a Donation Form in Netcommunity? I thought about shoehorning something in to the Email Communications Preferences part but that is not really the best fit.

Any thoughts or ideas greatly appreciated!

Regards,

Chris

  • Hello Chris,

When using a NetCommunity donation form to submit a recurring gift, the donor has to actively and knowingly provide the recurring gift amount and frequency of the gift. This gift capture process complies with Visa's regulation. The actions that a donor needs to take to set up the parameters for the recurring gift, and then finally submit the form, meets visa's requirements.

    Hope this helps!

  • Hi Pallavi,

Thanks for this. I'm not so sure that this act of "implied consent" would pass VISA's mandate of "Explicit Consent".

    eg items 1.1- 2.1  in https://usa.visa.com/dam/VCOM/download/about-visa/visa-rules-public.pdf

    But I'm not a lawyer... :-)

Thanks again for the information and Blackbaud's position on this.

    Cheers,

    Chris
  • I still have yet to investigate the consent fields that are new-ish to RE, but perhaps they could be of use, Chris Coey‍?
  • Hi Heather,

No, that feature is of no use, since you really need a "per transaction" record (e,g, for those that donate recurring, or more than once per year).

I was able to add a gift attribute on the constituent record for recording this, so we're all good now.

    Thanks,

    Chris
  • We use a gift attribute and require a check box with some donation pages that state that the donor has read and agreed to the Giving Policy.

Would a gift attribute work for this situation?

  • Hi Candy,

Yup, that's exactly what I ended up doing too (except I used a drop-down with YES and NO values) instead of a checkbox, since we *still want the donation* even if they don't want to consent to storing the CC key info. :-)

    Cheers,

    Chris
